TERMS OF SERVICE

Welcome to Oceangogo. Please thoroughly review these terms and conditions before utilizing the services offered by Oceangogo. The term “Oceangogo” specifically refers to OCEANGOGO COMPANY LIMITED in the content below. If you disagree with any of the stipulated terms, cease all use of our web services and exit this site immediately.

This website is provided by Oceangogo. These terms of use are subject to change without notice. If you continue to use this website after changes have been made, it will be considered that you have accepted the new terms.

Booking Services and Payments

  • Listing Charges: As of now, yacht owners or companies listing yachts for sale on Oceangogo are not subject to any posting fees. However, we reserve the right to alter this policy in the future.
  • Deposits: Clients must pay a deposit of 50% of the total price of the activity when booking services. Following the successful processing of the payment, Oceangogo will send a order confirmation via company email.
  • Confirmation: Receipt of an order confirmation from Oceangogo finalizes your booking. To modify or cancel a booking, clients must contact our customer service within office hours, adhering to our cancellation and refund policies.
  • Full Payment: Full payment for services must be made at least 7 days before the event date. If the event is less than 7 days away, full payment must be completed within 24 hours. Failure to comply will result in Oceangogo withholding the right to provide services, and the deposit will be non-refundable.
  • Currency: All online payments are processed in Hong Kong dollars. Fees incurred from payments made in other currencies will not be refunded.
  • Payment Collection: Each yacht owner or supplier designates Oceangogo to collect payments on their behalf. They are responsible for delivering services to clients who have paid through Oceangogo.
  • Third-Party Payment Systems: We utilize third-party payment systems and do not store any payment card information. Users are responsible for any fees charged by third-party providers (e.g., Stripe, Kpay).
  • Alternative Payment Methods: In addition to online payments, Oceangogo accepts payments via bank transfer and cash.

CANCELLATION AND REFUND POLICY

  1. Cancellation: If a client cancels due to personal reasons or withdraws during the course of the event, leading to the discontinuation of the activity, all fees paid will not be refunded.
  2. Mechanical Failure: If the boat/yacht experiences a mechanical failure before departure and cannot be repaired in a timely manner, Oceangogo will notify the client as soon as possible to reschedule or, depending on availability, provide a replacement boat/yacht of the same class. The client may choose to accept the rescheduled date or request a refund. If a refund is chosen, Oceangogo will refund the full cost of the boat/yacht.

ADVERSE WEATHER ARRANGEMENTS

  1. Extreme Weather: If a No. 3 typhoon signal or black rainstorm warning is still hoisted within two hours before the scheduled departure of the event, the itinerary for that day may be rescheduled for safety reasons. In other cases, such as a No. 1 typhoon signal, red and yellow rainstorm warnings, or thunderstorm warnings, rescheduling is not allowed. If the event is voluntarily terminated under these conditions, all fees are non-refundable.
  2. Others Weather Condition: If a No. 1 typhoon signal or red rainstorm warning is hoisted within two hours before departure, the boat/yacht will depart as scheduled. Please keep in contact with Oceangogo.
  3. Change in Weather During Journey: If a No. 3 or higher typhoon signal, red or black rainstorm warning is hoisted during the charter period, the captain has the right, according to maritime regulations of Hong Kong and for safety reasons, to return early. The remaining time of the event will not be compensated or rescheduled.

RESCHEDULING ARRANGEMENTS

  1. This clause applies to all clients who have been confirmed by Oceangogo as eligible for rescheduling due to weather factors or other reasons.
  2. Rescheduling Policy: Regardless of whether the charter is for a weekday or Weekend/public holiday, Oceangogo will only arrange for rescheduling within the same year on a weekday. No refunds will be accepted.

IMPORTANT NOTICES

  1. Arrival Time: Please arrive at the designated pier/location in advance to avoid delays due to traffic or other factors. If clients are late and this results in a reduced charter time, they will bear the corresponding losses.
  2. Capacity Limits: The number of client boarding must not exceed the specified limit, and Oceangogo has the right to refuse extra persons from boarding.
  3. Damage to Facilities: During the activity, if any facilities are damaged, stolen, or removed by clients, they will be responsible for the cost of repairs or replacement, as well as for any economic losses incurred to the boat/yacht during the repair period. Normal wear and tear are not covered by this clause.
  4. Pet arrangement: Generally, clients are not allowed to bring pets on board. If there is a special need, an application must be made before the booking. Otherwise, Oceangogo has the right to refuse boarding and no refund will be provided.

PROHIBITED ACTIVITIES

  1. Safety Precautions: For safety reasons, dancing on all boat/yacht, jumping from the flybridge (if applicable), swimming at night or when visibility is poor; Bringing prohibited items on board are strictly forbidden. If illegal drugs are consumed on board or if there is any violation of these rules, Oceangogo has the right to immediately terminate the day’s event and report to the police, without any compensation being made.
  2. Alcohol and Medication Warning: Clients must ensure their own safety at all times when consuming alcoholic beverages or taking any medications on the boat/yacht. They must follow the instructions of the onboard concierge or the captain at all times, especially when engaging in high-risk activities such as swimming, diving, and boarding or disembarking the boat/yacht.
  3. Oceangogo is not responsible for any injuries incurred by pregnant women who participate in water activities against advice, or for children brought on board by adults who must be closely supervised and held responsible for their safety.

RESPONSIBILITY FOR PERSONAL PROPERTY

Personal Property: Clients are responsible for the safety and security of their personal belongings. Oceangogo is not responsible for any damage or loss that occurs during the event but can assist in arranging for the police if needed.

INSURANCE POLICY

Third-Party Liability Insurance: The boat/yacht provided by Oceangogo are insured with third-party liability insurance according to Hong Kong laws. The coverage is limited to what is included in the third-party liability insurance. If clients are interested in purchasing additional insurance to enhance protection during their journey, Oceangogo can facilitate this.

SAFETY FACILITIES

Safety Equipment: In accordance with maritime laws in Hong Kong, the boat/yacht provided by Oceangogo are equipped with life jackets, lifebuoys, and fire extinguishers.

INTELLECTUAL PROPERTY

  1. Our Intellectual Property: The materials on our website (excluding third-party content) are protected by copyright, trademark, trade secrets, and other applicable property and intellectual property laws. Unless explicitly authorized by us, users may not sell, license, rent, modify, distribute, copy, reproduce, transmit, display, perform, publish, adapt, edit, create derivative works, or otherwise handle these materials in any way.
  2. Use of Our Intellectual Property: Users may not directly or indirectly, manually or through computer programs, or in any other manner, singly or repeatedly, collect data or other content from this site to create or compile an anthology, compilation, database, or directory. Unless a user has requested and obtained our prior written consent through cs@oceangogo.hk, they may not display any part or content of this site using embedded links or web page frames.

LOCAL AND INTERNATIONAL LAWS

Due to the global nature of the Internet, clients agree to comply with all local regulations concerning online conduct and acceptable content. Specifically, clients agree to abide by all applicable laws regarding the transmission of technical data exported from Hong Kong or the jurisdiction where the client resides.

DISCLAIMER AND LIABILITY

  1. Clients expressly agree to assume the risk associated with using services provided by Oceangogo. Our products, services, and information are provided on an “as is” and “as available” basis.
  2. Oceangogo does not guarantee the results or quality of any information or services obtained through our website.
  3. Oceangogo will not be liable for failure to fulfill commitments or provide services due to circumstances beyond our control, including but not limited to delays or errors in the transmission of information, implementation or amendment of laws, conventions, regulations by governments or relevant authorities, natural disasters, etc.
  4. The Oceangogo website may contain materials submitted or displayed by third parties. Oceangogo assumes no responsibility for any loss or damage caused by third-party materials unless otherwise stated. Materials on our website do not necessarily represent the views or opinions of Oceangogo unless specified.
  5. If clients are dissatisfied with our website or services, do not agree with any part of the terms, or have any disputes or objections to the terms of service on our website, they should immediately stop using the services and leave the website.
  6. In case of discrepancies between the Chinese and English versions of the terms and agreements, the English version shall prevail.

LOCAL LEGAL REQUIREMENTS

The services provided by Oceangogo comply with the laws and regulations of the Hong Kong Special Administrative Region, specifically under Chapter 548D “Merchant Shipping (Local Vessels) (Certification and Licensing) Regulation,” Article 6 – Restrictions on Class IV Vessels.
